Abstract

The current system in the Netherlands means that the losing party in a lawsuit pays the winning party’s legal costs, but not all costs are reimbursed. There are limits to the amount of compensation, and costs are fixed at a flat rate, meaning that the winning party often still has to bear some of the costs itself. This article discusses the reimbursement of costs for legal and expert assistance in government intervention, comparing expropriation law and tolerance obligations as forms of government intervention in property rights.
